Hi Mispie.
Is the plant perhaps a chilli pepper?
And might the tree be an Elder?

thanks to all, i'm sure i will enjoy being here. i looked up the elderberry and i don't think this what i have. the seeds are in pods and the tree does not flower. the pods are in like a 3 sided heart shaped pod and when it dries out the seeds are inside it. seeds are black balls like stuff not a berry. mispie

Hi Mispie....welcome to GoY.

You can not have seeds without the tree flowering first - sorry it is an impossibility!

i'd go with an ornamental chilli too.
The other plant is bit more of a problem. But it must have had flowers at some point as moongrower says. perhaps they were a type of catkin/wind pollinated flower. that would make them very small and hard to spot.

SBG would catkin type plants have seeds in a pod?

yes they can do. the oak for example is a sort of catkin flower. the pod develops from the ovary and that can come in a range of shapes, and number of sections.
