You may be wondering if we have moved ,unfortunately not ….

I don’t think anyone could have had a more stressful time in selling a place as we have .
It all began when the people who are buying us started querying the building we have in our garden the Arcon it has Asbestos on it ,they queried as to its safety first by trying to get the price down by several thousand pounds as they wanted to convert it into a building for their son to live in , we had 3 Asbestos specialist in to prove it was a perfectly good building providing they didn’t start cutting /burning / or messing about with it in any way and that what they did with it was up to them , they decided they still wanted it so the sale went ahead .. I have already mentioned this in my previous Blog ..

We should have moved then unfortunately a first time buyer in the chain help things up .

I also mentioned the plans to build 126 houses at the end of this lane leaving the field in front of us empty for some time to come or so we thought , recently the Estate agents called us into his office to say the owner of the field in front of us ( the same ones who are planning the other buildings of 126 homes ) had put a land dispute on our garden into their solicitors hands claiming they own a strip of the ground along the field edge .
As you can imagine we were in shock we asked the owners to come to see us which they did but they still insisted they were right ,they are big greedy bullies who own so much ground & properties they are use to getting their own way , they stood there and said "we are disputing it and we’re going to have it " , we were sick with worry knowing they had the money etc. to go for it and that we were small fry compared to them ,we knew it was ours we bought a part of the field when we moved here they were saying it shouldn’t have been that much even though the owner put the stakes in to fence it off . The problem was there were no actual measurements written down, I even found old original photos showing the wire fence and tiny shrubs which are now fully grown …
We arranged to get our deeds from our solicitor clearly showing the boundary they still wouldn’t have it and said the dispute is going ahead , we then had a help from a fabulous person who does Land Reg plans etc. he was able to Scale the land Regs measurement from the original deed documents we then had our part measured one was overlaid on the other which actually proved we should of in fact had more land about another 40 ft into the field , the chap who did it for us is in touch with all solicitors through his work so he rang the field owners solicitor to tell him his findings and this week we heard they had dropped the case ,they knew they couldn’t win with our findings ,they expected us to give in to them.
We also found out this week they have plans to build 54-78 homes on the field in front of us they obviously wanted a little more ground to squeeze more in .
What a relief we’re so glad we beat the bullies but it is still on going as the solicitors still have to do their paper work to clear the dispute plus our buyer has to know what the dispute was about ,it’s so near Christmas it’s bound to slow things up ,we have packaging everywhere ,we sold our dining room suite also a bed ..thank goodness we’re going to our daughters for Christmas dinner my freezer is empty …,
Our Granddaughter has been visiting for a few days from London which cheered us up ..
I’m hoping to have some good news about the move soon , fingers crossed we will be sorted out early in the new year ..

ooohhh Amy what nightmare before Christmas , forgive the pun .... I was thinking how it was going .... good on you for not letting them have the land .... happy you are at your daughters for christmas ..... wont belong before you go and get settled in to the new place .... I bet you glad you are going ....

Oh my Gosh Amy, how awful. I'm so glad you stood strong against these bullies and won, but you certainly didn't need that extra stress. I would have loved to see their faces when they realised they had lost. I really hope everything from here on in goes smoothly for you and that you will be very happy in your new home, when you get there.

Gracious Amy, what a stressful muddle that you really could have done without! So glad that someone sensible stepped in and sorted it out in your favour, but I really sympathise with the limbo you are now in. Desperately hope that you will be able to be in your new house in the New Year - lots of luck. x

Oh Amy, you don't deserve all the hassle. There are horrid people out there who must go through life causing upset, they must be trying it on all the time, I hope one day they get their just desserts. I guess the solicitors close on Friday until Tues 2nd Jan, you'll get there in the end.

Congratulations Amy. I'm so glad that you stuck it out & had help proving them wrong. I'm sure they just thought you would give in to them so they thought it was worth a try. They don't care about the stress they cause. I hope it will be hassle free from now on. Have a lovely Christmas with your daughter & I hope the New Year sees you in your new home. Relaxez- vous.

Oh my word I do feel for you both, what a pain, thank goodness you won't be spending Christmas at home.......one day you will look back and sigh........try not to let it get you down, it will happen, Spring is just around the corner!

How horrendous for you Amy. It's very stressful when someone disputes your boundary. It happened with my parents and it affected their health. I hope you won't let it get you down too much. You are in the right and no bullies can change that.

Well done indeed for sticking to your guns Amy. The bullies deserve to lose the extra strip as well. Hope you'll be able to forget about the stress over the weekend and have a well earned break to set you up for the move. Have a lovely Christmas in spite of it all.😏

Thank you for all your comments and encouragement , this is the latest up-date ..

.. we had a call to say we must measure ,stake and rope off the 40 ft area in the field which is under dispute on Wednesday , what a job that was especially along the ditch side Tony had to chain saw through trees and me lopping off branches going towards the old stable and then struggling through the brambles on the field ,it’s a wonder we didn’t kill ourselves ,it was a huge area from our front fence almost going to the other side of the field ,the owner of the field came round yesterday the sight of the roped of area must have frightened him because he’s been pulling out the stops getting in touch with solicitors to get an exchange of land from us to him once that’s done and we sign and agree to it plus the people buying ours agree the sale should all go ahead .. fingers crossed mine are permanently crossed these days …I’m actually wondering if our buyers solicitor might advice him not to sign and to insist on having it as it will be a valuable piece of land ,let’s hope he’s not as greedy as the owner was this would never have happened if they hadn’t tried to take a piece of our garden ..Amy x

Take a deep breath and give your poor crossed fingers a rest.
Glad you were victorious with the speculators.. miserable creatures! When they found out you had sold they had to bring up the easement or it would have snagged their plans with the planning board, do you think?
I hope you can have a calmer few days over Christmas...enjoy the family and relax as best you can.

Oh my goodness Amy I've been absent so long it's the first I've heard of the awful time you are going through and I am so sorry. A 'normal' house move is stressful enough but what you have endured is enough to turn you bald....
Every week though, is a step nearer to your being settled and happy in your new home early in the new year. I hope you have a lovely relaxed time with your daughter.

So the buyers want to convert an outbuilding on your property into another residence? If the sale went through then no sweat. If it didn't and the lender got wind of that intention....OMG! By that I mean that the lender (if there is one) might make the mtg contingent upon obtaining a variance to allow two separate residences on one parcel of land even if the buyers said that they were only toying with that idea. Lenders don't like encumbrances which might diminish property values.

Well, well, Amy, what a to do!
I've not been online over Christmas so only just seen your latest news.
For goodness sake hang onto that extra 40' - it will be a valuable asset to the property & will also stop anyone from building up to the boundary & especially after you nearly killed yourselves struggling through brambles & chain-sawing thru trees!

The same thing happened to the vendor here with our property except it was Greene King brewery's & the elderly couple owners didn't have a helpful land reg person so they ended up paying for it but it took from Sept to March to finalise.
Don't sign over to the greedy field owner!

Oh Amy, so sorry to hear about this extra hassle but so pleased you had a good one on your side and you came out on top. Fingers and everything else crossed that things will now move forward. I have been without internet for a while because of a change in internet provider but am now back on board, thank goodness. I'm glad you had a break away from it all over Christmas and may the new year bring you completion and every happiness. God bless.

Up-date ... we are in Limbo ,Nothing has happened over the Christmas period as far as we can tell the solicitors don't return to work until the New Year . Mari we won't try to keep the extra 40 ft even though we know it would be a valuable piece of land it would hold our sale up for months probably even longer while the dispute goes ahead we would lose our sale plus the property we are hoping to buy ... we know it was never ours this was obviously a mistake on the Land Registration part ...
Guess what my computer broke down over Christmas it was impossible to get anyone to look at it until yesterday The maintenance man had to install a new email program he did the best he could to keep me going until we move and then I must look at something new probably a Laptop ,my computer is getting old I have to go to my contacts copy and then return to me email page to paste the address ,it's all very time consuming ...
Can anything else go wrong :o( .. Xx

So, who paid the property tax on that strip of land all that time? If the owner of the adjacent land claims that he owns it when did he wake up to that premise and why were you not given prior notice of that fact while you were maintaining that strip of land and paying the property tax for him at your own expense. If in fact you were paying his tax on that property he claims to own and you were maintaining it for him at your own expense, all for a number of years,....seems to me that he owes you $$$$, with interest since he got a free ride on that land at your largesse.

Amy, nothing official ever happens between Xmas & New Year but hopefully things will get cracking for you soon after. Tom said he'd be fuming over the field business & you should send them a bill for the stress & delay it's caused you.

Amy, I can't tell you how I feel for you. I do hope you can get things sorted to everyone's mutual satisfaction, really soon. When I hear about people such as yourselves and their problems selling/moving I thank my lucky stars I've no intentions of moving, unless it's in a pine box and I have wonderful neighbours. I've got my fingers crossed for you.

Thank you all for coming along my journey with me ,
Up-Date .. it's all systems go ,we decided to sign the extra piece of land back to the greedy people as we know we never did own a part of the field it would have held up the sale indefinitely losing us the property we want plus we may well have lost the sale of ours , we're just grateful they couldn't lay claim to our garden .
We are due to move on Thursday the 18th Only a month or so late Ha ha ...
We are unable to get BT until the week afterwards so will be without Computer / Broadband/ Telephone etc .. wish us luck ! x

Thanks all ,what an experience ,we've had some moves in our time but never anything so complicated as this ..
I'm writing very quickly as I expect to get 'cut off ' at any moment ,I'm surrounded by packing boxes everything is disappearing even our shoes have gone (It's true) and our coats ,we needed a stamp to post a letter they had gone to . I'm hoping they leave the bed until tomorrow Lol .. Sheila I wouldn't be at all surprised if we don't equal your calls it's a nightmare getting anything done ..... x

I'm wondering how the move went for you today.
I was thinking about you while Storm Georgina raged. Norfolk, Suffolk & parts of Essex suffered the worst high winds since the '87 hurricane. I heard over 100 trees were downed in Norfolk, here in Suffolk our electric was off till lunch time, some roads & rail lines blocked by fallen trees & a couple of lorries were blown over.

I do hope it went smoothly for you though, after all the difficulties you've had it seems as though the powers that be don't want you to move at all!
